Terms and Conditions of Sale

These Terms and Conditions of Sale (the "Terms") govern sales made on sphereperformance.run by SUPRAW (Sphere Performance brand), a limited liability company (SARL) with share capital of €1,500, registered with the Toulouse Trade and Companies Register under number 900 408 006, to any consumer customer. Any order implies unreserved acceptance of these Terms.

Article 1 — Products

Products are described as accurately as possible. The photographs shown on the Site are not contractually binding. Products are offered while stocks last. If a product becomes unavailable after an order, the customer will be informed as soon as possible and may choose an exchange or a full refund.

Article 2 — Prices

Prices are shown in euros (€), all taxes included, excluding delivery charges. Delivery charges are indicated and accepted by the customer before the order is finally confirmed. Products are invoiced at the rate in effect at the time of the order. SUPRAW reserves the right to change its prices at any time, without affecting orders already confirmed.

Article 3 — Order and payment

The sale is final after confirmation of the order and receipt of payment. Payment is made online by credit/debit card and other available methods (Apple Pay, etc.) through a secure payment solution. Payment data is encrypted and is not stored by SUPRAW. A confirmation summary email is sent to the customer upon validation.

Article 4 — Delivery

Products are delivered to the address provided by the customer when ordering. The available delivery methods (pickup point, home delivery, international), estimated times and applicable charges are presented at checkout.

In accordance with Article L.216-1 of the French Consumer Code, the maximum delivery time is 30 days from the date the order is confirmed. If this period is exceeded for reasons not attributable to force majeure, the customer may cancel the order by registered letter with acknowledgment of receipt or by email, and obtain a full refund within 14 days.

The risks related to transport are transferred to the customer upon actual delivery of the product by the carrier.

Article 5 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to give reasons.

The customer informs SUPRAW of their decision to withdraw using the model form attached to these Terms, or by any other unambiguous statement, sent to: sphereperformance.contact@gmail.com

Products must be returned in their original condition, unworn and unwashed, within 14 days of notifying the withdrawal. Return shipping costs are the customer's responsibility. The refund is made within 14 days of receiving the returned products or proof of return shipment.

Article 6 — Legal guarantees

SUPRAW is bound by the following legal guarantees:

  • Legal guarantee of conformity (Art. L.217-3 et seq. of the French Consumer Code): the customer has 2 years from delivery of the goods to take action. They may choose between repair and replacement of the goods (Art. L.217-9), subject to the cost conditions provided for by law. This guarantee applies without having to prove the existence of the lack of conformity during the first 24 months.
  • Guarantee against hidden defects (Art. 1641 et seq. of the French Civil Code): the customer may request cancellation of the sale or a price reduction if the defect makes the goods unfit for their intended use.

Article 7 — Personal data

Personal data collected when ordering is processed in accordance with the General Data Protection Regulation (GDPR — EU 2016/679). It is used exclusively for order management and customer relations. Article 8 — Disputes and mediation

These Terms are subject to French law. In the event of a dispute, the customer is invited to first contact our customer service at sphereperformance.contact@gmail.com to seek an amicable solution.

In accordance with Article L.612-1 of the French Consumer Code, the customer may use a consumer mediator free of charge: [TO BE COMPLETED — name and contact details of the approved mediator].

The customer may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

Failing an amicable resolution, the competent French courts will have jurisdiction.
